COMPLAINT / CONCERN

Common Issues addressed by our code enforcement officers include the following but not limited too:

Building Elements – Siding, Roofing, Windows, Doors, Plumbing, Electrical/Communication Wiring, etc.

Site Elements – Overgrown Landscaping (including Grass), Right-of-Way Trees, Debris/Garbage, Rodent Infestation, Unlicensed Vehicles, Sidewalk Maintenance & Accessibility, Dumpster Maintenance & Location, Portable Signs etc.

Vacant/Abandoned Properties
In efforts to limit the number of properties within the Town left vacant, abandoned, or as a zombie property the Town seeks the community’s assistance. If you suspect a property may be vacant, abandoned, or considered a zombie property please contact 716-897-7200 ext.9 to report the property in question. Additionally, a complaint can be registered with the
NYS Department of Financial Services (DFS)

What is a Zombie Property?
A property left vacant or abandoned in which the ownership has been relinquished to the mortgage/lending company and maintenance schedule has not been established.

COMPLIANCE RESOURCES

Code Enforcement Officers are tasked under New York State Law with ensuring that all properties within the Town meet the minimum applicable code standards to ensure the safety of the community. Issued violations will provide the corrective action needed to be taken in order to become complaint with code standards or corrective action will be enacted by the Town at the property owners expense. VIOLATION FEES & PENTALIES

After failure to comply with a notice of violation order issued by the Town of Cheektowaga in the allocated time-frame specific to each violation, corrective action can be taken by the Town at the expense of the property owner and/or may be subject to the following fines and/or punishment.

Landscape Overgrowth Violation (Chapter 66)
First Offense is punishable by a fine of $200 and a additional variable fine based on extent of removal.
Unpaid (in-full) within the first 30-days shall be considered cause for a property lien and will incur interest at the same rate applied for unpaid real estate property taxes.

Building Code Violation (Chapter 70)
First Offense is punishable by a maximum fine of $250 and/or a maximum 15-days jail sentence.
Each calendar day the violation is continued shall be considered a separate additional violation.

Zoning Violation (Chapter 260)
First Offense is punishable by a fine of $50 to $350 and/or a maximum 15-days jail sentence.
Second Offense in a 5-Year period is punishable by a fine of $350 to $700 and/or a maximum 15-days jail sentence.
Third Offense in a 5-Year period is punishable by a fine of $700 to $1,000 and/or a maximum 15-days jail sentence.
Upon Third Offense, each calendar week the violation is continued shall be considered a separate additional violation.
